DWI - Child Passenger

Any DWI arrest when a child passenger under the age of 15 is in the vehicle is:

A felony of the third degree.

As a felony of the third degree; if convicted of any DWI, even a 1st offense, when a child under the age of 15 is in the vehicle has a sentence of:

  • Up to a $10,000 fine.
  • Jail time between 2 years and 10 years.
  • Rehabilitative confinement for alcohol treatment.
